South Korean Neurosurgeon Fined After Fatal Postoperative Negligence
A South Korean neurosurgeon, Kim Yong-ho, has been fined for negligence after a patient died following neck surgery. The Incheon District Court ruled that Dr. Kim failed to provide proper postoperative care, leading to the fatal outcome. The case involved a cervical spine disc operation at Inha University Hospital in June 2021.
On June 21, 2021, Kim Yong-ho performed cervical spine disc surgery at Inha University Hospital. After the procedure, he left work without ordering or checking an X-ray to monitor the patient’s condition. The next day, the patient suffered airway obstruction due to bleeding and died.
The court determined that the neurosurgeon had neglected to detect and remove a postoperative hematoma. His failure to monitor the patient directly contributed to the fatal complications. The Incheon District Court imposed a fine of 15 million won (approximately $10,370) for professional negligence. In reaching its decision, the court considered a settlement between the doctor and the victim’s family. It also took into account that Kim had no prior criminal record. Despite these factors, the ruling confirmed that his actions had caused the patient’s death.
The fine of 15 million won reflects the court’s finding that negligence led to the patient’s death. The case highlights the importance of postoperative monitoring in surgical care. Kim Yong-ho remains liable for the professional oversight that resulted in the fatal outcome.
