Haitian Asylum Seeker Daphy Michel Dies of Hypothermia Days After ICE Release
Daphy Michel, a 31-year-old Haitian asylum seeker, died on 2 March 2023. Her death was ruled a homicide caused by hypothermia. She had been released from federal custody just three days earlier in inadequate clothing for the winter conditions. Daphy Michel was taken into custody in 2022 after an incident linked to her untreated mental health issues. ICE placed her in removal proceedings following her arrest for shouting at imaginary people. Despite her vulnerability, she was released on 27 February 2023.
At the time of her release, she suffered from severe mental health problems and faced a significant language barrier. She was found at a bus shelter wearing clothes suited for September, not the freezing February weather.
The Allegheny County Medical Examiner’s Office later confirmed her death was a homicide resulting from hypothermia, caused by another individual’s actions. ICE only learned of her death three days afterwards through news reports. Local officials have condemned the circumstances of her death. Allegheny County Executive Sara Innamorato called it a preventable tragedy that could have been avoided with basic humanity. U.S. Rep. Summer Lee stated Michel deserved care, shelter, language support, and medical help. Her attorney now expects the family to take legal action against ICE over her death.
